By accessing or using davidpotterrealtor.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Site.

No Broker Relationship Formed by Site Use

Browsing the Site, submitting a contact form, requesting a home valuation, or otherwise providing your information does not create a real estate brokerage, agency, or fiduciary relationship between you and David Potter Brokerage or David Potter, its REALTOR®. A representation relationship is only formed through a signed written agreement. Until such an agreement is signed, no information you provide should be treated as confidential in the way it would be once a formal representation relationship exists.

Informational Purposes Only

Content on davidpotterrealtor.com — including market information, neighborhood guides, blog posts, and the relocation guide — is provided for general informational purposes only and does not constitute legal, tax, financial, or investment advice. Property values, availability, inventory, and market conditions change frequently and should be independently verified before you rely on them for any decision.

MLS / IDX Listing Data

Property listing data displayed on the Site (including the search tool) is sourced from the California Regional Multiple Listing Service (CRMLS) or other IDX data feeds and is provided “as-is.” Listing information, including price, availability, and property details, is not guaranteed to be accurate, complete, or current, may contain errors, and is subject to change or withdrawal without notice. Always verify listing details independently before making any decision. Display of this data is subject to the terms of the applicable MLS’s IDX program.

Automated Home Valuation Estimates

The “What’s My Home Worth” tool may display an automated value estimate generated by a third-party data provider. This estimate is a computer-generated approximation only, is not an appraisal or a Comparative Market Analysis performed by David Potter Brokerage, and should not be relied upon for lending, tax, legal, or any other purpose requiring a precise or professionally certified valuation. Actual market value can differ significantly, especially for unique, view, or non-standard properties. Contact David Potter directly for an accurate, professionally prepared valuation of your property.

No Warranty

The Site and all content on it are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free.

Limitation of Liability

To the fullest extent permitted by law, David Potter Brokerage, its REALTOR David Potter, and their respective agents, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of, or inability to use, the Site or its content, even if advised of the possibility of such damages. Your sole remedy for dissatisfaction with the Site is to stop using it.

Indemnification

You agree to indemnify and hold harmless David Potter Brokerage and David Potter from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your submission of content or information through the Site, or your violation of these Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
